Belativo LLC Seller Terms and Conditions

These Terms and Conditions (“Terms”) govern your participation as a seller (“Seller”) on the international e-commerce marketplace (“Platform”) operated by Belativo LLC (“Belativo”). By registering as a Seller and listing products on the Platform, you agree to abide by these Terms.

1. Registration and Account

1.1. To become a Seller on the Platform, you must register and create an account.

1.2. You agree to provide accurate, complete, and up-to-date information during registration and to update your account details as necessary.

1.3. You are solely responsible for maintaining the security of your account and password. Any unauthorized use of your account must be reported to Belativo immediately.

2. Product Listings

2.1. You are responsible for the accuracy, completeness, and legality of all product listings, including descriptions, images, prices, and any other relevant information.

2.2. You must ensure that all listed products comply with applicable laws and regulations in both the seller’s country and the destination countries.

2.3. You may not list counterfeit, illegal, or prohibited products as determined by Belativo’s policies.

3. Order Fulfillment and Shipping

3.1. Belativo will handle all aspects of shipping, including packaging, delivery, and related costs.

3.2. Sellers are responsible for securely preparing their artwork for pickup or drop-off at a designated location specified by Belativo.

3.3. Belativo reserves the right to change its shipping policy at any time, including shifting shipping responsibilities or costs to Sellers, with prior notice.

3.4. Any disputes or claims related to lost, delayed, or damaged shipments will be handled by Belativo in accordance with its internal policies.

4. Payment, Fees, and Pricing

4.1. Belativo reserves the right to determine the final sale price of any product listed on the Platform, regardless of the artist’s internal listing price.

4.2. Belativo may apply additional charges, markups, or fees at its sole discretion. These fees may be based on operational costs, promotional strategies, platform fees, or any other business considerations.

4.3. The artist’s internal listing price is provided as a base rate, and the final customer-facing price may differ from this amount.

4.4. By listing on the platform, Sellers agree that Belativo has full discretion over pricing adjustments, discounts, or promotional offers that may be applied to their products.

4.5. Belativo covers all shipping, packaging, transaction, and platform service fees associated with selling on the Platform. Sellers will not be responsible for any costs related to order fulfillment, except for securely preparing their artwork for pickup or drop-off at a designated location specified by Belativo.

4.6. Belativo reserves the right to modify its pricing and fee structure at any time. If any changes are made, Sellers will be notified in advance.

4.7. Payments will be disbursed upon confirmed delivery of the artwork to the buyer.

5. No Returns or Refunds (Except for Faulty Products)

5.1. Due to the nature of art sales, all sales are final, and no refunds, exchanges, or returns will be permitted unless required by law.

5.2. However, if a product is found to be faulty, damaged, misrepresented, or significantly different from its description, Belativo reserves the right to inspect the product and determine whether a refund is warranted.

5.3. In such cases, Belativo will:

• Conduct an independent review of the issue, including requesting evidence such as photos or video proof.

• Decide whether the product meets the standard of quality expected from the Seller.

• Reserve the right to refund the customer in full or in part if the product is deemed defective or not as described.

5.4. If a refund is issued due to a faulty product, the Seller may be held responsible for the refund amount, and future payments may be withheld to cover the cost.

5.5. Any disputes regarding refunds will be handled at Belativo’s sole discretion, and its decision will be final.

6. Customer Service

6.1. You agree to provide professional and timely customer service to buyers, including responding to inquiries related to your artwork.

6.2. Belativo may assist in resolving customer concerns but does not guarantee resolution in favor of either party.

7. Quality Control and Compliance

7.1. Sellers are responsible for maintaining quality control and ensuring that all artworks meet the standards set by Belativo.

7.2. You represent and warrant that all artworks sold on the Platform are original, authentic, and accurately described.

7.3. You must comply with all applicable laws, regulations, and industry standards related to art sales.

8. Intellectual Property and Marketing Rights

8.1. By listing products on the Platform, you represent and warrant that you own, or have obtained, all necessary rights to use any intellectual property associated with your listings, including images, trademarks, and descriptions.

8.2. By selling on Belativo, you grant Belativo a non-exclusive, royalty-free, worldwide, and perpetual license to use your artwork, product listings, and branding materials for promotional, advertising, and marketing purposes.

8.3. This includes, but is not limited to, digital marketing, social media campaigns, email promotions, online advertising, and other public relations activities.

8.4. Belativo may edit, modify, or enhance product images and descriptions for promotional purposes while maintaining the integrity of your work.

8.5. If you wish to opt out of certain promotional uses, you must submit a written request to Belativo, subject to approval.

9. Indemnification

You agree to indemnify, defend, and hold harmless Belativo LLC, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses (including legal fees) arising from:

• Your breach of these Terms

• Your violation of any laws or regulations

• Any claims related to the artwork you sell, including but not limited to intellectual property disputes or false advertising

10. Termination

10.1. Belativo reserves the right to suspend or terminate your account at any time, with or without notice, if:

• You violate these Terms

• You engage in fraudulent, abusive, or unethical business practices

• Belativo determines, at its sole discretion, that continued business with you is not in the Platform’s best interest

11. Modification of Terms

11.1. Belativo reserves the right to modify these Terms at any time. Any modifications will be effective upon posting on the Platform.

11.2. It is your responsibility to review these Terms periodically to ensure compliance.

12. Governing Law and Dispute Resolution

12.1. These Terms shall be governed by and construed in accordance with the laws of the International Chamber of Commerce (ICC).

12.2. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the International Chamber of Commerce (ICC).

12.3. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

13. Acknowledgment and Agreement

By registering as a Seller on Belativo, you acknowledge that you have read, understood, and agree to be bound by these Terms and any related policies referenced herein.
